1. Information about the Seller and Purpose of the Document

This website (www.lanomobila.ro) is operated by Cezary Siwik, who conducts business activity under the name “LANO MEBLE” Siwik Cezary, an authorised natural person (sole trader) registered in Poland, with its registered office at Tyble 43C, postal code 98-420, Sokolniki Commune, Łódź Voivodeship, Poland. Identification details: NIP (tax identification number) 6190013551, REGON (registry number): 100363308, VAT code (RO): RO54580918. Hereinafter, this operator shall be referred to as the “Seller”.

This “Commercial Terms and Conditions” document sets out the general framework for online sales through the lanomobila.ro website and the conditions for its use. By placing an order or using the website, you, as the Buyer, accept the Terms and Conditions below in full. If you do not agree with any of the provisions, please do not use the website. The Seller reserves the right to unilaterally amend the Terms and Conditions, with any updated version applying only to future orders (and not to those already in progress). We recommend checking this page periodically before each purchase.

2. Definitions and General Aspects

Buyer: any natural person (consumer) aged at least 18 years or legal person (company) who places an order on the website. Consumers benefit from the rights specific to consumer protection legislation, whereas legal persons do not benefit from the same rights (for example, the 14-day right of withdrawal does not apply to them).

Sales Contract: the distance agreement concluded between the Seller and the Buyer by completing an order on the website, the subject matter of which is the sale and delivery of the ordered products. The contract shall be deemed concluded at the moment when the Seller confirms acceptance of the order by e-mail (the shipping confirmation).

User Account: the section of the website (password-protected) in which the Buyer can manage their data and order history. The Buyer is responsible for the confidentiality of the password and of the account data. The Seller may temporarily restrict access to the account for maintenance or technical updates.

Products: the goods displayed on the website (furniture, mattresses, etc.) that can be ordered online. The Seller makes efforts to present the characteristics of the products (dimensions, colours, materials) as faithfully as possible; however, there may be slight differences in perception (e.g. colour shades may vary depending on the screen). All products sold are new and comply with the description and the applicable quality standards.

3. Registration and Placing Orders

3.1. Account creation (optional) – The Buyer has the option of creating a user account on the website by providing a valid e-mail address and other necessary information. Upon registration, you must provide correct and complete data; update it as necessary in your profile. Any incorrect information may lead to delays in processing orders. By creating an account, you may receive periodic notifications about new products and offers, but you may unsubscribe at any time from your account or by using the unsubscribe link in the e-mails received. The Seller is not obliged to send these notifications to all users, and the service may be withdrawn or limited without prior notice.

3.2. Placing an order – Orders may be placed online by following the steps indicated on the website. The Buyer adds the desired products to the basket, completes the delivery and payment information, and then confirms the order. Before completion, you will have the opportunity to check and, if necessary, correct the order details (products, quantities, address, payment method). By completing the order, the Buyer declares that all data provided are correct and that they have the legal capacity to conclude the contract.

3.3. Order confirmation and conclusion of the contract – After the order is placed, the Seller will send an e-mail confirming receipt of the order. This e-mail does not constitute firm acceptance of the order, but only confirmation of its receipt. The distance Sales Contract shall be deemed concluded at the moment the e-mail confirming shipment of the products (or the notification of collection from the store, where applicable) is sent to the Buyer. The Seller reserves the right to refuse an order before the shipping confirmation, for example in the event of obvious errors on the website (an erroneous, very low/unusual price), lack of stock or problems arising during payment processing. In such situations, the Buyer will be informed as soon as possible and, if payment has already been made, the amounts paid will be refunded.

3.4. Product availability – All product offers are valid while stocks last. If an ordered product is no longer available or a significant delay in delivery occurs, the Seller will inform the Buyer and offer the option of waiting for delivery, replacing the product with a similar one (if possible and accepted by the Buyer) or cancelling the order for that product with a refund of the amount paid for it (if payment has been made).

3.5. Cancellation or modification of the order – The Buyer may request the cancellation or modification of an order before it is shipped by urgently contacting the Seller at the e-mail address reclamatii@lanomobila.ro or by telephone (if a contact number is available). The Seller will make efforts to assist with modifications (such as changing the delivery address, adding/removing a product), but cannot guarantee that the request will be fulfilled if the order has already been processed logistically. If you cancel the order after it has already been handed over to the courier or reaches its destination, this will be considered a voluntary return and the rules on the right of withdrawal will apply (see the Consumer Protection Policy).

4. Prices and Payment Methods

4.1. Product prices – The price of each product is displayed on the dedicated product page and in the shopping basket, expressed in Lei (RON). Prices include VAT (value added tax) in accordance with the applicable tax legislation. The prices displayed do not include delivery costs, which are added separately during the ordering process, depending on the delivery option chosen and the recipient's address. If pricing or display errors occur, the Seller will inform the Buyer before the shipping confirmation in order to reconfirm the order at the correct price or to cancel it.

4.2. Promotions and discounts – From time to time, the Seller may offer promotions, coupons or price reductions. Any discounts communicated via the website, e-mail or promotional materials apply under the specified conditions (e.g. limited period, limited stock, eligibility criteria). Discounts cannot be combined with one another unless expressly provided. In the case of discount coupons, these will apply in accordance with the communicated rules (one coupon per order, valid only for certain products or categories, etc.).

4.3. Accepted payment methods – When completing the order,

the Buyer may choose one of the available payment methods:

Cash on delivery (ramburs) – payment in cash of the order value directly to the courier upon receipt of the parcel (valid only for deliveries within the territory of Romania and within the limits of the amounts permitted by law for cash transactions).

Online bank card – secure payment by credit/debit card (Visa, MasterCard, etc.) at the time the order is placed. The transaction is processed through a certified payment processor, and the website does not store card details.

Bank transfer (payment order) – the option of paying by bank transfer to the account indicated by the Seller (available in particular for legal persons). The order will be shipped after confirmation that the funds have been received in the Seller's account.

4.4. Payment terms – The price of the products and any delivery costs must be paid in full before or upon delivery, depending on the method chosen. In the case of online card payment or bank transfer, the payment obligation shall be deemed fulfilled at the moment the amount is credited to the Seller's account. For cash on delivery, the amount will be paid in Lei, exactly as shown on the confirmed invoice/order, upon receipt of the parcel. The Seller reserves the right, for high-value orders or in certain situations (e.g. new customer, suspected fraud), to request advance payment (partial or full) before shipment. The tax invoice will be issued in electronic or printed form and will accompany the delivered goods or will be sent by e-mail, in accordance with legal provisions.

5. Delivery of Products

5.1. Delivery area – The Seller makes deliveries throughout the territory of Romania. As a rule, delivery is carried out by express courier services to the address specified by the Buyer. The Buyer is responsible for providing a correct and complete delivery address. Deliveries are not made to post office boxes. If delivery outside Romania is desired, this may be possible only with the prior consent of the Seller (additional transport costs may be required and restrictions may apply).

5.2. Delivery time – The estimated delivery time is displayed on the website (e.g. “shipping within 3 days” for certain products) or will be communicated upon order confirmation. Usually, products in stock are shipped within 1-3 working days, and courier delivery generally takes between 2 and 7 additional working days, depending on the destination. For products marked with a longer lead time (e.g. made-to-order or personalised products), delivery may take longer, in accordance with the information on the website. Although the Seller makes every effort to meet the indicated deadlines, delays beyond its control may occur (adverse weather conditions, busy periods for couriers, force majeure situations, etc.). A justified delay in delivery shall not be considered a breach of contract. The Buyer shall not claim compensation for reasonable delays; however, if the overrun becomes significant (more than 30 days from the date of order confirmation, without a valid or accepted cause), the Buyer may cancel the order and receive a refund of the amounts paid.

5.3. Delivery costs – The cost of delivery (transport fee) will be displayed separately when placing the order, before it is completed. The Seller offers free delivery for orders exceeding a certain value (e.g. orders over 1299 Lei benefit from free transport, in accordance with the campaigns displayed on the website). For orders below the mentioned threshold, a fixed or variable delivery cost will be charged, depending on the weight/volume of the parcels and the destination. The Buyer will see the calculated transport cost in the basket before confirming the order. In the case of special transport offers (e.g. periods with free transport on any order), the conditions communicated in the respective offer will apply.

5.4. Delivery and receipt conditions – Delivery is made to the address indicated by the Buyer, usually to the front of the building (block of flats, house). The courier is not obliged to carry the parcels upstairs or inside the home, so the Buyer must ensure that they can receive the products. Upon receipt of the parcels, please check the integrity of the packaging and, if you notice visible damage to the package, you may refuse delivery or ask the courier to draw up a report of findings. Any problems relating to the condition of the products or items missing from the parcel must be reported to the Seller within a maximum of 48 hours from delivery. Any subsequent complaint concerning visible aspects (mechanical impacts, scratches, missing accessories) may be difficult to resolve favourably.

5.5. Transfer of ownership and risk – Ownership of the products passes to the Buyer at the moment of full payment of the order (in the case of advance payment) or at the moment of physical receipt of the products (in the case of cash on delivery). The risk of accidental loss of or damage to the products passes to the Buyer at the moment when the Buyer or a representative designated by the Buyer takes physical possession of the goods. If the Buyer has designated their own carrier to collect the products, the risk passes upon delivery of the products to that carrier.

5.6. Delays attributable to the Buyer – If delivery cannot be made for reasons attributable to the Buyer (e.g. the address provided is incorrect/incomplete; the Buyer cannot be contacted by the courier; the Buyer refuses receipt without valid reasons), the Buyer may be required to bear the costs of any re-delivery. Furthermore, in the event of an unjustified failure to collect a parcel that is returned to the Seller, the Seller may refuse to fulfil other subsequent orders from that Buyer or may require advance payment.

6. Warranties and After-Sales Services

6.1. Legal guarantee of conformity (for Consumers) – All products sold benefit from the legal guarantee of conformity for a period of 2 years from delivery, in accordance with Law No. 140/2021 on the sale of goods and the associated guarantees and Ordinance No. 21/1992 on consumer protection. This means that the Seller is liable for any lack of conformity of the product (manufacturing defects, hidden defects, non-conformity of the product with the description) arising within 2 years of delivery, if the Buyer is a consumer (natural person). In the event of a lack of conformity, the Buyer has the right to request, free of charge, the repair or replacement of the product and, if these are not possible within a reasonable period, an appropriate price reduction or a refund of the price (termination of the contract). Any remedy will be provided within a maximum of 15 calendar days from the date on which the Buyer notified the Seller of the defect or non-conformity. In order to benefit from the guarantee, the Buyer must keep the purchase documents (invoice, warranty certificate – if issued). The legal guarantee does not cover normal wear and tear of the products, defects caused by improper use, incorrect handling, incorrect assembly (contrary to the instructions) or unauthorised interventions on the product. In the case of legal persons (professional clients/professionals), the 2-year legal guarantee does not apply according to the law; such clients benefit only from the commercial guarantee offered by the manufacturer, if any, under the conditions specified by the manufacturer.

6.2. Commercial guarantee (additional, where applicable) – Certain products may benefit from a commercial guarantee offered by the manufacturer or by the Seller, extending beyond the legal guarantee. For example, there may be X-year guarantees for the durability of a certain component, if promoted as such. The details of commercial guarantees (duration, coverage, conditions of application) will be specified in the warranty certificate accompanying the product or in the description on the website, where applicable. The commercial guarantee does not affect the consumer's statutory rights regarding the guarantee of conformity, but is in addition to them.

6.3. Claims during the guarantee period – For any guarantee request, the Buyer may contact us at reclamatii@lanomobila.ro, providing the order/invoice number, identification details and a description of the problem encountered, preferably accompanied by photographs illustrating the defect. The Seller will register the complaint and communicate to the Buyer the resolution procedure (e.g. return of the product for inspection/repair, sending an authorised service technician to the home for repairs – depending on the nature of the product, direct replacement of the defective part, etc.). If the solution is the return of the product for repair or replacement, the Seller will bear the related transport costs (if the complaint is justified, i.e. the defect is covered by the guarantee). The remedy time may vary but will not, as a rule, exceed 15 days from the date of receipt of the returned product, as mentioned above. If the reported defect is not covered by the guarantee (e.g. a defect caused by the customer's own fault, the product does not exhibit the reported fault, the guarantee period has expired, etc.), the Seller will inform the Buyer of this and of the available options (for example, repair for a fee, return of the unrepaired product, etc.).

6.4. Assembly service and instructions – Furniture products are generally delivered disassembled, together with assembly diagrams and instructions. The Seller does not offer home assembly services unless this is explicitly mentioned as an additional service (normally this is not the case for lanomobila.ro). The Buyer is responsible for assembling the products in accordance with the instructions provided. Failure to carry out the assembly correctly may lead to damage to the product or to safety risks; these aspects are not covered by the guarantee. If you experience difficulties with assembly or find that parts/accessories needed for assembly are missing, contact the Seller for support.

7. Right of Withdrawal (Return of Products)

7.1. The Customer (Consumer ) has the right to withdraw from this contract, without giving any reason, within 60 days, without incurring any costs other than those provided for by law (which represents an extension of the 14-day period for the right of withdrawal provided for by the Consumer Rights Law – Government Emergency Ordinance (OUG) No. 34/2014)..

7.2. Exercising the right of withdrawal – To exercise your right of withdrawal (you must notify the Seller by means of an unequivocal statement expressing your decision to withdraw from the contract. You may do so by e-mail at reclamatii@lanomobila.ro or by using a withdrawal form (It is not mandatory to use the model form; it is sufficient to inform us in writing of your intention to return and of the order details (order number, product, date of receipt).

7.3. In addition, the consumer may also submit a statement of withdrawal from the sales contract to the seller using the «withdraw from the contract here» function (in accordance with Directive 2023/2673 of the European Parliament, i.e. through the online form ("Withdraw from the contract here") available on the website or from within the user account. The consumer immediately receives confirmation of receipt of the form submitted via the website. Where the statement referred to in paragraph 7.3 is submitted, and is submitted in accordance with its provisions, the Seller must immediately confirm, on a durable medium (by e-mail to the e-mail address provided in the form), receipt of the Customer's statement of withdrawal from the sales contract concluded in the Online Store.

You will receive confirmation of receipt of the withdrawal request. According to the law, it is sufficient to send this notice of withdrawal before the expiry of the withdrawal period (14 days) for the deadline to be considered met.

7.4. Obligations of the Buyer in the event of withdrawal – If you have exercised your right of withdrawal, you must return the products to the Seller without undue delay and no later than 14 days from the date on which you informed us of your decision to withdraw. The deadline is considered met if the products are sent back before the 14-day period has expired. The return will be made by sending the products to the address indicated by the Seller (which will be communicated in the return instructions). The direct costs of returning the goods will be borne by the Buyer (in accordance with the law), except where the Seller voluntarily offers to bear them (currently, the Seller does NOT offer free return shipping). The Buyer is liable only for any diminished value of the products resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the products. In other words, you may examine and test the product in the same way as you would in a physical store, but any excessive use or use that results in damage to the product may reduce the amount refunded (the Seller has the legal right to withhold an amount corresponding to the loss in value). To avoid such situations, return the product in its original condition, in its original packaging, with all accessories and documentation received.

7.5. Condition of products upon return – The products you return must not be damaged and must not show signs of excessive wear or unauthorised interventions. We recommend returning them in the original packaging and packing the goods carefully to prevent damage in transit. If the product is received in a damaged condition or with missing accessories due to the Buyer's fault, the Seller reserves the right to reduce proportionally the amount to be refunded or even to refuse the return in serious cases (e.g. a product returned in a condition that no longer allows it to be resold). Note: The absence of the original packaging will not lead to the refusal of the return when the statutory 14-day right is exercised, but may result in an amount being withheld to restore the product to its original saleable condition.

7.6. Exceptions to the right of withdrawal – According to the law, there are certain types of products for which the right of withdrawal does not apply. Please note that returns are not accepted for the following categories of products (if they were sold on lanomobila.ro):

Products made to the customer's specifications or clearly personalised for the customer's needs (e.g. made-to-order furniture with non-standard dimensions or special engravings requested by the customer).

Sealed products which cannot be returned for reasons of health protection or hygiene, if they have been unsealed by the Buyer (e.g. mattresses, toppers, pillows or bed linen, if they have been removed from the protective hygienic packaging).

Goods that are liable to deteriorate rapidly or expire (e.g. food products, cleaning products, etc. – not usually applicable to furniture).

(The above list is in accordance with the legislation in force – Article 16 of OUG No. 34/2014 – and is for information purposes. The Seller will specify in the product description whether a particular item falls within the exceptions. Currently, most furniture products can be returned, except for those personalised at the customer's request.)

7.7. Refund of amounts – In the event of withdrawal, the Seller will refund the value of the returned products within a maximum of 14 days from the date on which it is informed of the decision to withdraw. Important: The refund will include only the price of the products, excluding the initial delivery costs. In other words, the transport fee paid for the initial delivery will not be refunded. The refund will be made using the same payment method used by the Buyer for the initial transaction, unless the Buyer expressly requests another method and this is agreed. The Seller may withhold the refund until the actual receipt of the returned goods or until proof of dispatch of those goods is provided (whichever is earlier). If the Buyer paid for express delivery or another additional service, only the cost of standard delivery (if any) would be refundable under the law – in the present case, as there are no different delivery options, the cost of standard delivery is in any event not refunded in accordance with the Seller's policy.

8. Limitation of Liability

8.1. Use of the website – The Seller makes efforts to ensure that the information on the website is correct, up to date and complete. Nevertheless, there may be editorial errors, incorrect prices, omissions or other technical problems. The Seller does not guarantee that the operation of the website will be uninterrupted or error-free. Any complaints relating to the operation of the website may be sent to the support contact. The Buyer uses the website at their own risk; the Seller shall not be liable for any damage arising from the inability to use the website, viruses, cyber attacks or other unforeseen events, to the extent that reasonable security measures have been taken.

8.2. Contractual relationship – The Seller does not assume liability for indirect, special or punitive damages or loss of profit suffered by the Buyer in connection with the performance of the distance contract. The Seller's liability, if proven, for any loss or damage suffered by the Buyer in connection with the purchase of a product is expressly limited to the amount paid by the Buyer for the respective product. In other words, the maximum compensation that may be claimed from the Seller shall not exceed the price of the product in dispute. The Seller is not responsible for any delays or non-performance caused by force majeure or unforeseeable events (e.g. labour disputes, natural disasters, acts of authorities, etc.).

8.3. Photographs and content – The product images on the website are for guidance only. Although the Seller seeks to present images that are as faithful as possible, minor differences in shade or appearance compared to reality may occur for technical reasons. These differences do not constitute non-conformities. All texts, descriptions, graphics and other content elements on the website are the intellectual property of the Seller or its partners and are protected by law. Copying, distributing, publishing or using any materials from the website without the Seller's consent is prohibited.

8.4. Communications – The Buyer assumes responsibility for the accuracy of the contact details provided (e-mail, telephone, address). The Seller cannot be held liable if important information (e.g. order confirmations, delivery notifications) does not reach the recipient due to errors in the e-mail address provided or due to messages being filtered as spam.

9. Applicable Law and Dispute Resolution

9.1. Governing law – Any contract concluded between the Seller and the Buyer through the lanomobila.ro website is governed by Romanian law. This applies regardless of the Buyer's nationality or the country from which the order is placed, given that the Seller directs its activity towards consumers in Romania. In relations with consumers, the Romanian legal provisions in force on consumer protection and electronic commerce shall apply, as well as the applicable EU Regulations (such as Regulation (EU) 2016/679 – GDPR, for data processing aspects).

9.2. Amicable settlement – The Seller and the Buyer will attempt to settle amicably, through dialogue and direct negotiations, any dispute arising out of or in connection with an order. Buyers may at any time submit complaints or notifications to the Seller by e-mail at reclamatii@lanomobila.ro. Complaints received will be analysed and a reasoned response will be sent within a maximum of 14 days (if a longer period is needed for investigation, the Buyer will be informed). Consumers may also contact the National Authority for Consumer Protection (ANPC) or other mediation bodies for assistance or advice in resolving a grievance.

9.3. Alternative Dispute Resolution (ADR) – If the complaint is not resolved amicably, the consumer has the right to resort to alternative dispute resolution procedures under the conditions of Government Ordinance (O.G.) No. 38/2015. The Seller is open to participating in amicable mediation or arbitration procedures if the consumer proposes them through an authorised ADR entity. The list of ADR entities in Romania (mediation centres, arbitration, etc.) is available on the ANPC website. This approach may be useful for resolving disputes more quickly without going to court.

9.4. Jurisdiction of the courts – If an amicable solution is not possible, any dispute between the Seller and the Buyer shall be submitted for resolution to the competent courts in Romania. For consumers: territorial jurisdiction lies with the courts of the consumer's domicile or the court of the Seller's registered office, at the consumer's choice, in accordance with consumer protection legislation. For clients that are legal persons or PFAs (professionals): the parties may agree on the jurisdiction of the courts of the Seller's registered office (Poland) or of the registered office of lanomobila.ro in Romania, if one exists; in the absence of such an agreement, disputes shall be resolved by the Romanian courts of the consumer's registered office where the special rules apply, or by the courts of the Seller's registered office in the other cases. The applicable law remains Romanian law, and this choice of law does not deprive you of the protection of the mandatory provisions of your country of habitual residence, in accordance with the Rome I Regulation (for consumers).

9.5. Final provisions – If any clause of these Terms and Conditions is declared null or unenforceable by a court, the validity of the remaining provisions shall remain unaffected. Any such invalid clause shall be replaced by a provision that comes as close as possible to the original intention and complies with the legal framework. This document, together with the Privacy Policy, the Cookie Policy and the Consumer Protection Policy, constitutes the entire agreement between the parties (Seller and Buyer) regarding the use of the website and the transactions carried out through it. By accepting these Terms at the time of placing the order, the Buyer confirms that they have read, understood and agree to all of the clauses above. For any further clarification, please feel free to contact us at reclamatii@lanomobila.ro.

10. WCAG

The website is (partially) compliant with the WCAG 2.1 standard at level AA. Conformity with the WCAG criteria results from the European standard EN 301 549, implemented by the Act of 26 April 2024 on ensuring compliance with accessibility requirements for certain products and services by economic operators.
